1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of Homelab: Server Simulator, including the Game, website, digital content, features, updates, and related services (collectively, the “Service”).

The Service is operated by BuildWithVikesh (“we”, “us”, “our”, or the “Developer”).

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you must not download, install, access, or use the Service.

2. Eligibility

You may use the Service only if you are legally permitted to do so under the laws applicable to you.

If you are below the applicable age of majority or another age required for consent in your jurisdiction, you should use the Service only with the involvement and permission of a parent or legal guardian where required by law.

3. License to Use the Game

Subject to your compliance with these Terms, the Developer grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Game on compatible devices that you own or control for personal, non-commercial entertainment purposes.

This license does not transfer ownership of the Game or any intellectual property to you.

All rights not expressly granted under these Terms are reserved by the Developer and its licensors.

4. Restrictions

You agree not to:

• copy, reproduce, redistribute, sell, rent, lease, or sublicense the Game except where expressly permitted by law;
• modify, adapt, translate, reverse engineer, decompile, or disassemble the Game except to the extent such restriction is prohibited by applicable law;
• attempt to obtain the source code or underlying algorithms of the Game;
• bypass, disable, interfere with, or circumvent security, authentication, anti-cheat, licensing, or technical restrictions;
• use cheats, exploits, unauthorized automation, bots, scripts, hacks, or modified versions of the Game;
• interfere with the operation or infrastructure of the Service;
• use the Service to violate applicable laws or regulations;
• impersonate the Developer or another person or organization;
• use the Service to distribute malware or other malicious code; or
• use the Service in a manner that could damage, overload, or impair the Service or other users' access to it.

5. Intellectual Property

The Game and all associated materials are protected by intellectual-property laws.

This includes, where applicable, software, source code, object code, game mechanics as protectable, artwork, graphics, interfaces, animations, audio, music, text, logos, trademarks, branding, names, documentation, websites, and other content provided by or on behalf of the Developer.

Except for the limited license expressly granted by these Terms, no ownership rights are transferred to you.

6. Game Content and Updates

The Developer may add, remove, modify, rebalance, replace, or discontinue Game features, content, mechanics, progression systems, items, interfaces, or other elements at any time.

Updates may be required to continue using certain versions or features of the Game.

We do not guarantee that any particular feature, item, game mechanic, progression system, or piece of content will remain available permanently.

7. Game Progress and Saved Data

Game progress may be stored locally on your device or through supported online or platform services.

We do not guarantee that saved progress, configuration, achievements, inventory, settings, or other Game data will always be preserved.

Data may be lost because of device failure, application deletion, updates, synchronization problems, technical failures, corrupted data, platform changes, security incidents, or circumstances outside our reasonable control.

8. Third-Party Platforms and Services

The Service may depend on or integrate with third-party platforms and services, including application stores, authentication services, payment providers, advertising networks, analytics providers, cloud infrastructure, and other technology providers.

Your use of those third-party services may be subject to their separate terms, policies, and requirements.

The Developer does not control third-party services and is not responsible for their independent operation, availability, policies, content, or practices.

9. Purchases and Digital Content

The Game may offer optional digital purchases, subscriptions, downloadable content, virtual items, or other paid features.

Where purchases are offered through an application platform, the applicable platform's payment and purchasing systems may process the transaction.

Unless otherwise stated, digital content provided through the Service is licensed to you rather than sold to you as physical property.

Digital content generally has no cash value outside the Service and may not be sold, transferred, exchanged, or redeemed for real-world money unless expressly permitted by the Developer and applicable law.

Refunds are handled according to the applicable platform's refund policies and applicable law.

10. Advertising

The Service may contain advertisements provided by the Developer or third-party advertising providers.

Advertising availability, format, frequency, and providers may change without notice.

The Developer is not responsible for the products, services, claims, or practices of independent advertisers.

11. User Feedback

If you submit suggestions, ideas, feedback, bug reports, or recommendations regarding the Service (“Feedback”), you grant the Developer a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, distribute, display, and otherwise use that Feedback for any lawful purpose.

You agree that the Developer may use Feedback without compensation, attribution, or obligation to you, subject to applicable law.

You should not submit confidential information through Feedback unless specifically requested by the Developer.

12. User Conduct

You are responsible for your use of the Service and for complying with applicable laws.

We may investigate suspected misuse, abuse, fraud, security violations, cheating, exploitation, or violations of these Terms.

Where reasonably necessary, we may take appropriate action, including restricting or terminating access to the Service, subject to applicable law and platform requirements.

13. Security and Abuse

Attempting to compromise, attack, disrupt, reverse engineer, or interfere with the Service or its supporting infrastructure is prohibited.

This includes unauthorized access attempts, exploitation of vulnerabilities, malicious traffic, distribution of modified clients, cheating systems, and other activities intended to compromise the integrity or availability of the Service.

14. Availability and Changes

The Service is provided subject to availability.

We may temporarily suspend or restrict the Service for maintenance, updates, security reasons, technical issues, infrastructure changes, legal requirements, or other legitimate operational reasons.

We do not guarantee uninterrupted, error-free, or permanently available access to the Service.

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis without warranties of any kind except those that cannot lawfully be excluded.

To the maximum extent permitted by law, we disclaim warranties relating to merchantability, fitness for a particular purpose, non-infringement, availability, reliability, accuracy, and uninterrupted operation.

We do not guarantee that the Service will satisfy every user's expectations, operate on every device, remain compatible with every operating-system version, or remain free of bugs or interruptions.

16. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer and its owners, operators, contributors, licensors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Service.

This may include, to the extent permitted by law, loss of data, loss of progress, loss of profits, loss of business opportunity, device problems, service interruption, or other indirect losses.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless the Developer and its owners, operators, contributors, licensors, service providers, and affiliates from claims, liabilities, damages, losses, and expenses arising from your unlawful use of the Service, your violation of these Terms, or your violation of another person's rights.

18. Suspension and Termination

We may suspend or terminate your access to the Service if you materially violate these Terms, engage in fraud or abuse, compromise security, interfere with the Service, or where reasonably necessary to protect users, the Developer, or the Service.

You may stop using the Service at any time by uninstalling the Game and ceasing use of related services.

Provisions that by their nature should survive termination, including intellectual-property rights, disclaimers, limitations of liability, indemnification, and dispute-related provisions, will survive termination to the extent permitted by law.

20. Governing Law

These Terms will be governed by the applicable laws of India, except to the extent that mandatory laws applicable to you require otherwise.

Any dispute will be subject to the jurisdiction of the courts having lawful jurisdiction over the relevant matter, subject to any mandatory consumer or other legal rights that apply to you.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, features, business practices, technology, applicable law, or operational requirements.

The updated version will be published on this page and the “Last Updated” date will be changed accordingly.

Your continued use of the Service after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

22. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

A failure or delay by the Developer to enforce any provision of these Terms does not constitute a waiver of the Developer's right to enforce that provision later.

These Terms, together with the Privacy Policy and any additional terms expressly applicable to particular features of the Service, constitute the agreement governing your use of the Service, except where applicable law requires otherwise.
